The service
BlackBeard Web Design ("we," "us") designs, builds, hosts, and maintains websites for small businesses. Plans and pricing are described on our homepage; the specifics of your engagement are confirmed by email when you sign up.
Free demo
Demo websites are provided free of charge and without obligation. Until you purchase a plan, a demo remains our property and may be modified or taken down at any time.
Portfolio samples
The sample websites shown on this site are demonstration builds. Business names, people, contact details, reviews, and ratings shown in samples are fictional and for illustration of design capability only. They do not depict real businesses or real customer reviews.
Plans, billing, and cancellation
- Monthly plan: billed monthly, no long-term contract. You may cancel at any time; service continues to the end of the paid period, then the site is taken offline.
- Annual plan: billed once per year, covering twelve months of the monthly plan's services.
- Domain: included the first year on paid plans; renews at $20/year thereafter unless you decline renewal.
- Buyout: a one-time purchase that transfers the website design and files to you. Optional hosting after buyout is billed separately.
- Fees already paid are non-refundable except where required by law.
Ownership
Until a buyout is completed, website designs, code, and generated imagery remain our property; you have a license to use them for your business while on an active plan. Content you supply (your logo, your photos, your text) remains yours. After a buyout, the delivered site is yours.
AI-generated content
Websites may include AI-generated photography, video, and text. Where imagery is generated rather than photographed, it is illustrative and may not depict your actual premises, staff, or products. You are responsible for reviewing your site's content for accuracy about your business before and after launch.
Your responsibilities
You confirm that information and materials you provide are accurate and that you have the right to use them. You are responsible for your business's own legal compliance (licensing, advertising rules for your trade, and similar).
No guarantees of results
We work to make your website fast, professional, and findable, but we do not guarantee search rankings, traffic volumes, call counts, or revenue. Reports we provide describe measured activity, not promised outcomes.
Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of the services is limited to the amounts you paid us in the three months before the claim arose. We are not liable for indirect, incidental, or consequential damages, or for downtime caused by third-party providers (such as hosting, domain registries, or Google).
Termination
We may suspend or end service for non-payment or unlawful use. You may cancel as described above.
Governing law
These terms are governed by the laws of the State of Texas. Disputes will be handled in the courts of El Paso County, Texas.
Changes
We may update these terms; the current version will always be posted here with an updated date. Continued use of the services after a change means you accept the new terms.
